Michael Erdman

Michael H. Erdman received his undergraduate degree in Business Administration from Washington University (St. Louis) and his law degree, cum laude, from Boston University School of Law. He is admitted to practice in Illinois, Missouri, and a number of federal jurisdictions. Mr. Erdman concentrates his practice on business litigation, including antitrust, real estate, insurance coverage (representing policyholders), commercial, copyright, trademark, agricultural (PACA), contract and tort matters, in addition to general business representation. He has appeared before state and federal courts, and various state and local administrative bodies and arbitration panels.

Mr. Erdman represents non-traditional real estate brokers and For Sale By Owner websites, counseling them on state real estate broker laws and inquiries from state real estate commissions and local Realtor boards.  Since 2005 he has generally advised a group of 90+ flat-fee real estate brokers throughout the U.S. on antitrust law, state license laws and regulations, Realtor board and multiple listing service rules, and related litigation.  Mr. Erdman has responded to inquiries from 60 Minutes, Money Magazine, Forbes, Inman News and several hedge funds pertaining to competition issues affecting non-traditional real estate brokers and websites.

Mr. Erdman has served as outside counsel to My Pie and Li'l Guys restaurants since 2003.

For six years Mr. Erdman was extensively involved in federal multidistrict antitrust litigation on behalf of a Fortune 500 defendant.  In Re: Compensation of Managerial, Professional and Technical Employees Antitrust Litigation, MDL 1471 (D. N.J.). Along with co-counsel, he helped to (twice) successfully oppose class certification, (twice) defeat FRCP 23(f) petitions, and obtain summary judgment against named plaintiffs. 

Mr. Erdman is Editor of the Real Estate, Real Competition & the Law blog, which was nominated as a 2007 Finalist for Inman News' "Most Innovative Blog." The blog chronicles the experiences of innovative real estate brokers and websites that offer U.S. consumers more choices when buying or selling a home.

Mr. Erdman is also Editor of the Online Liability Blog, which covers laws and litigation that regulate, challenge and in some cases immunize websites and other online players. The blog focuses primarily on federal appellate court decisions construing 47 U.S.C. § 230(c)(1).

Mr. Erdman has written articles published in BLUEPRINTS - The Produce Professionals' Quarterly Journal:  "Federal Trade Laws that Shape Business Practices" and "As the Crow Flies - Guidelines and legalities to consider for 'local' labeling." 

Mr. Erdman has been an Amateur (Ham) Radio Service licensee for twenty-six years, and serves as a Volunteer Counsel for the American Radio Relay League. He has also served as a Volunteer Counsel for the Concerned Members of Chatham Park Village Cooperative and the American Real Estate Broker Alliance, and a Board Member of the Chicago Institute for the Moving Image.
